Interesting post, thanks. My question is how does the NLRB view company sponsored United Way drives at companies with Non Solicitation policies and active union avoidance policies?

Kris Dunn

Hey Puf -

Here's how I think companies try to manage that. You say that you pick two to three non-profit orgs that do donation drives, and those become your "official" charity. That way you don't say OK to just anything while still participating in what really matter to the community - all while not putting yourself at too much risk from a solicitation standpoint....

Good article. Especially the solicitation issue ie.NLRB example.
The company matching donation policy is a good initiative to demonstrate community outreach for selective charities. Some companies donate a portion of their profits to charities as well. Target comes to mind. As pointed out, on an individual basis once you let one person peddle candy bars in the office you have to let others as well, and inevitably there will be that one situation whereby the cause will create a debate or be offensive to someone. Whether at the macro level or the individual level, NLRB, or individual, the mom and apple pie all American Girlscouts become the indirect victims of those who would manipulate the system.
